Terms and Conditions

Usage and your offer to purchase any goods from our web site, means that you agree to the terms and conditions that follow:-

1. Pricing Policy & Product Descriptions

Our pricing policy, as set out on www.laughingdonkey.co.uk ("the web site") or in any other form of promotional material that we may issue is expressed in Pounds Sterling (£) and would be fully inclusive of our standard delivery charges. Special Delivery can also be arranged as described in section 2 below.

The prices and product descriptions as shown on the web site, or in any other form are accurate and are representative of the goods on offer. However our pricing and product descriptions will be validated by us at the time we consider your offer to order. In the case where any errors or omission have occurred, we will notify you at the earliest possible opportunity to enable you to make one of the following considered decisions: -

  • Decide whether to proceed with the order at the correct price or proceeding on the basis of having been given a revised description of the actual goods, or -
  • To cancel the order, without any further liability on the part of you (‘the purchaser’) or us (‘the supplier’).
  • We reserve the right to change the price of any goods, their description or the cost of any delivery charges without prior notice. However no price alterations will be made after the order has been despatched

    2. Ordering, Delivery, Cancellation and Returns

    2.1 Ordering

    By ordering products from our web site you offer to purchase the goods that are contained within your on-line order. Upon receipt of your order we will subsequently confirm our acceptance by e-mail and it is only when we despatch your order that a binding contract is created between us. Payment must be received in full prior to despatch.

    You can pay by: - Visa, MasterCard, Switch, Solo, Delta or Visa Electron. Transactions are processed using encrypted secure pages with Barclaycard Merchant Services.

    We reserve the right to refuse or reject any offer to purchase from us at any time.

    Our order confirmation will include: -

  • Our Company details
  • An order reference number
  • A description of the goods that have been ordered during the on-line transaction and their unit cost.
  • The total price, including delivery.
  • 2.2 Delivery

    We will deliver your order to the UK address, which you notified at the time of placing your order. Please note that we are unable to supply goods outside of the UK.

    Unless otherwise stated, we aim to deliver your goods to you within 5 working days, following the receipt of full payment.

    On the rare occasion that we are unable to deliver your goods within 30 days we will notify you so that we can either agree a longer delivery period, or agree to refund you the cost of the outstanding order, including carriage costs.

    We will utilise standard Royal Mail (First Class) or 'Standard Parcels' delivery service, combined with suitable packaging to protect the goods whilst in transit. Recorded Delivery and Special Delivery options are also available. Up to date prices will be shown during the on-line shopping process.

    NB. In some cases a signature may be required upon delivery.

    If the goods should be returned to us ‘Undelivered’ we shall refund the cost of the goods within 30 days including the delivery charges less £5.00, or the value of the goods (whichever is less) to cover the cost of administration.

    We can only be held liable for the loss of goods up to the cost of their appropriate value and no more.

    Delivery notes will be enclosed within each delivery consignment.

    2.3 Cancellation and Return of Orders

    In the unlikely event that you are not entirely satisfied with your order, once this has been received, you may exercise your right to return the goods, for up to 7 working days, starting from the day after the goods were received. This is in accordance with the United Kingdom’s Distance Selling Regulations 2002 or as amended from time to time.

    This is provided all reasonable care has been exercised whilst the goods remain in the purchaser’s possession. The goods must be returned in their original packaging in a resalable condition. We will refund any money that you have paid, within 30 days of receipt of the returned goods.

    To cancel your order you must either e-mail or write to us at the address shown on the ‘Contact Us' section of this web site. Full details of your reason for cancelling the order should be clearly stated.

    In all cases the purchaser must bear the cost of carriage and any insurance, if chosen, when returning any unwanted or unsuitable goods. We recommend that you insure the goods for their full retail value and keep all receipts for carriage, in order to provide proof of return. We will repay any carriage costs, up to a maximum of £6.00, if the goods were found to be faulty. Our discretion in relation to determining the true status of the returned goods is final.

    NB. Regrettably the above Cancellation and Returns policy does not relate to computer software, computing programs, or where there is a hygiene and public health interest.

    3. Availability

    All orders are offered on a subject to availability basis. If for any reason the goods cannot be supplied within 30 days of the order being placed, we will refund you any money that has been paid including delivery charges, unless we both agree to a longer delivery period. Beyond this we hold no further liability.

    4. Appropriate Goods

    Some goods on our web site may not always be suitable for all age groups; some items could pose a danger if not operated strictly in accordance with the manufacturer's instructions or exercised with adequate care or supervision. It may even be unlawful to sell particular goods to certain age groups.

    Furthermore, we should point out that some products may have parts that could be harmful to small children.

    We would strongly recommend that you consider whether your chosen item is entirely appropriate for the intended recipient . We would stress that we cannot be held liable if adequate care and supervision has not been exercised to prevent any accident or danger.

    Please do not be offended if occasionally we enquire as to the suitability of certain products, when ordering, especially if you have younger members of the community in mind.

    5. Privacy Policy

    We respect the privacy of our customers and would confirm that the information that we gather from you during the course of your on-line transaction, or at any other time is necessary only so that we may process your order accurately and efficiently.

    You may if you so wish, withhold any personal information, which is not needed for the fulfilment of the transaction.

    Upon your written request we will provide you with details of the personal information that we hold on our files or database.

    We will not send you e-mails without your consent. It is accepted that in response to any offer to purchase goods from us, you give your consent for us to reply by e-mail. Your personal details and information will not be sold, traded, rented or passed to any third party.

    6. Computer Viruses

    We cannot guarantee that our web site will be free from viruses or other infecting programmes.

    7. Complaint Policy

    In the unlikely event that you should have any complaint about the products or service that we deliver, you should contact us, within 14 days of delivery, either by e-mail or in writing at the address shown on the 'Contact Us' section of our web site.

    Your complaint will be acknowledged within 5 working days, with appropriate explanations given where possible at this stage, or an indication of when we would expect to be able to resolve your complaint.

    If the products that we delivered were not as ordered or if they are damaged, or defective in any way, we will replace those items, upon their return, or credit your account with the value of the goods and any delivery charges at our discretion. Replacement will be subject to the continued availability of those items that were comprised in the original order.

    If you do not receive the goods or any part of the original order within 28 days, you should notify us so that corrective action or a refund can be agreed. Where appropriate we will also refund the cost of any additional delivery charges that were paid.

    8. Statutory Rights

    Your statutory rights are not affected by any of the above.

    9. Governing Law and Jurisdiction

    The contract is governed by and construed in accordance with English Law.
